Judge: Prosecutors Can’t Use Wiretap Evidence In Gang Cases

Dozens of alleged gang members arrested in north suburban Lake County may soon have their cases thrown out because prosecutors didn’t get the right signature on the wiretapping applications.

A judge ruled this week that only a state’s attorney can sign off on wire tap applications. The Lake County State’s Attorney’s Office had allowed an assistant state’s attorney to sign, and the judge ruled that none of the wiretap evidence can be used at trial.

In a statement, the state’s attorney’s office said it will appeal that ruling.
